Terms of Use
These Terms of Use govern your access to and use of the Enforce Assist website and services, including any software solutions powered by the Eccentex App-Base platform (“Software”). By using the Site and services, you agree to be bound by these Terms of Use. Should you or your organization have separate agreements with Eccentex Corporation, those agreements will govern your use of the platform as well. Please read these Terms carefully. If you do not agree, you must stop using the services immediately.

1. Acceptance of Terms
By accessing our Software, Site, or services, you accept and agree to these Terms of Use. If you or your organization has a separate agreement with Eccentex Corporation, your Terms of Use will be governed by both that agreement and these Terms. If you do not agree to these Terms of Use, do not access or use the Software or Site.
2. Limited Authorization to Access
Enforce Assist and Eccentex make Software available to you subject to these terms:
- You may use the Software only if you are over 13 years of age.
- You may download, view, or print materials published by Enforce Assist on the Site for internal, non-commercial use or for supporting Eccentex and Enforce Assist products.
- You are prohibited from altering, modifying, or using the Software or information in any way other than as explicitly authorized.
Any copy or use of materials should retain all copyright and proprietary notices, and any unauthorized use of the Software, Site, or content is strictly prohibited.
3. Use of Software
The Software made available through the Site is the intellectual property of Eccentex and its suppliers. Your use of the Software is governed by the License Agreement that accompanies or is provided with the Software. This agreement outlines your rights and obligations regarding the use, access, and functionality of the Software.
- If accessing Software via the internet, you are responsible for obtaining internet access and the necessary equipment to use the Software.
- Software access is provided on an “as is” basis, and you must comply with all local, state, national, and international laws governing your use of the Software.
4. Organization Accounts and Administrators
Enforce Assist’s Software allows organizations to create accounts with administrative control. Your administrators are responsible for configuring settings, managing user accounts, and ensuring compliance with these Terms. Enforce Assist is not responsible for internal administration of your account.
You are responsible for:
- Maintaining the confidentiality of your account passwords.
- Appointing competent administrators for managing your accounts.
- Ensuring that all activities on your account comply with these Terms.
If your organization loses control of its administrator account(s), Enforce Assist may, at its discretion, grant access to a representative with proper authorization.
5. Online Communities
Enforce Assist may provide online community services (forums, blogs, discussion groups, etc.) where users can post content. Users agree to use these platforms responsibly, uploading content that is relevant to the community and refraining from offensive or unlawful behavior. Enforce Assist reserves the right to moderate and remove content deemed inappropriate.
Content shared on these platforms is user-generated and does not reflect the views of Enforce Assist. We are not responsible for the accuracy or reliability of user posts.
6. Subscription to Beta or Trial Services
We may offer certain Software as beta or trial services for testing purposes. By accessing these Beta Services, you agree that Enforce Assist has the discretion to determine the testing period and success of these services. We reserve the right to discontinue Beta Services at any time without notice, and no user is obligated to continue paid services following a Beta trial.
7. Prohibited User Conduct
You agree not to:
- Use the Software for any illegal purposes, spamming, or unauthorized mass communication.
- Upload content containing malware, viruses, or any other harmful software.
- Defame, harass, or violate the legal rights of others through the Software.
- Attempt unauthorized access to the Software or associated accounts, servers, or networks.
Enforce Assist reserves the right to terminate your access to the Software in case of any violation.
8. Content and Data Ownership
Enforce Assist does not claim ownership of the content you upload to the Software. However, by posting content, you grant Enforce Assist and Eccentex a perpetual, worldwide, royalty-free license to use, modify, display, and distribute your content for the purpose of providing the services.
You retain ownership of the content stored or created by you within the Software. Enforce Assist will access and use this data solely to provide services and ensure Software functionality.
9. Fees and Payments
Subscription to Enforce Assist services may require payment. Subscription fees are automatically renewed unless you notify Enforce Assist at least 7 days before renewal that you do not wish to continue. Subscription fees are subject to change with prior notice. Enforce Assist reserves the right to terminate accounts for non-payment of fees.
10. Termination of Accounts
Enforce Assist reserves the right to terminate any user’s access to the Software without notice if there is a breach of these Terms. Upon termination, your account and data may be permanently deleted.
11. Limitation of Liability
Enforce Assist, Eccentex, and their affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of the Software. The total liability for any claim related to your use of the Software is limited to the amount paid by you for the services.
12. Indemnification
You agree to indemnify and hold Enforce Assist and Eccentex harmless from any claims arising from your use of the Software, including legal fees.
13. Arbitration
All disputes arising out of these Terms will be resolved through binding arbitration in California, according to the rules of the American Arbitration Association. Any legal actions must be filed in the jurisdiction of California.
14. Intellectual Property
All intellectual property related to the Software, including trademarks, copyrights, and patents, are owned by Eccentex or its licensors. No rights or licenses are granted except as specifically set out in these Terms.
15. Modifications to the Terms
Enforce Assist reserves the right to modify these Terms of Use at any time. Changes will be communicated on the Site, and your continued use of the Software constitutes acceptance of the updated Terms.
